Overview

This website is operated by Delineate Clothing. Throughout the website, the terms “we”, “us” and “our” refer to Delineate Clothing.

We offer this website, including all information, products, features and services available through it, subject to these Terms of Service.

By accessing our website, using our services or placing an order, you agree to these Terms of Service, together with any policies referenced in them, including our Shipping Policy, Return & Refund Policy and Privacy Policy.

Please read these Terms carefully before using our website or placing an order.

Nothing in these Terms limits or excludes any rights you have under mandatory consumer protection laws.

Section 1 – Eligibility and Use of Our Website

By using our website or placing an order, you confirm that you have the legal capacity to enter into a purchase agreement or, where required, have permission from a parent or legal guardian.

You may not use our website, products or services for any unlawful or unauthorised purpose.

You must not transmit viruses, malicious code or any other technology that could damage, disrupt or interfere with our website, systems or services.

We reserve the right to restrict or terminate access to our website where it is being used unlawfully, fraudulently or in breach of these Terms.

Section 2 – Products and Product Information

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizing information, specifications and other information displayed on our website are accurate.

However, the appearance of colours and products may vary depending on your screen, device and display settings.

Minor variations in colour, packaging, finish or appearance may occur where these do not materially change the nature or functionality of the product.

Product availability may change at any time. We may discontinue products or limit quantities where reasonably necessary.

Nothing in this section affects your statutory rights if a product is faulty, damaged, not as described or otherwise does not conform to your purchase agreement.

Section 3 – Orders and Purchase Agreements

When you place an order, you agree that the information you provide is complete and accurate.

After placing an order, you will receive an electronic acknowledgement or order confirmation.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including:

  • suspected fraud or unauthorised payment;

  • incorrect or incomplete customer information;

  • products becoming unavailable;

  • restrictions preventing us from delivering to the requested destination; or

  • an obvious pricing or technical error.

Where payment has already been collected for an order that we are unable to fulfil, the relevant amount will be refunded.

Any cancellation or refusal of an order will always be handled in accordance with applicable law.

Section 4 – Prices and Payment

Prices are displayed on our website in the currency shown at the time of purchase.

The total price payable will be displayed during checkout before you complete your order.

We reserve the right to change product prices at any time. Price changes will not affect orders that have already been validly concluded, except where permitted by applicable law.

Payment methods currently available will be displayed during checkout.

You agree to provide current, complete and accurate billing and payment information.

Section 5 – Free Shipping and Delivery

We offer free standard shipping on all orders. No minimum order value is required.

Orders are processed and delivered in accordance with our Shipping Policy.

Estimated delivery times depend on the destination and begin after processing and dispatch.

Our current estimated shipping timeframes and processing information can be found in our Shipping Policy.

Delivery estimates are provided in good faith but may occasionally be affected by circumstances outside our reasonable control, including customs processing, carrier delays, public holidays, severe weather, transportation disruptions or unusually high shipping volumes.

If a significant delivery delay occurs, you retain any rights available to you under applicable consumer law.

Section 6 – International Fulfilment, Customs and Import Charges

We may work with international suppliers, warehouses, fulfilment partners and shipping carriers to process and deliver orders.

As a result, orders may be shipped internationally.

Free shipping refers to the shipping charges that we charge for standard delivery. Depending on the destination country, customs duties, import taxes or other government charges may apply.

Where such charges are not included in the purchase price, they may be payable by the recipient in accordance with the rules of the destination country.

Where required by law, information regarding additional charges or the possibility of such charges will be provided before purchase.

Section 7 – Right of Withdrawal, Returns and Refunds

Consumers are entitled to any cancellation, withdrawal, return and refund rights provided by applicable law.

We provide a 14-day withdrawal period, beginning on the day you, or a third party designated by you, receives the product, unless a lawful exception applies.

To exercise your right of withdrawal, you must notify us within the applicable withdrawal period.

Further information regarding:

  • how to request a return;

  • return conditions;

  • return shipping costs;

  • damaged or incorrect products;

  • exchanges; and

  • refund processing

can be found in our Return & Refund Policy.

Nothing in our Return & Refund Policy or these Terms limits any mandatory statutory rights you may have.

Section 8 – Faulty or Non-Conforming Products and Legal Warranty

Products must conform to the purchase agreement and meet the standards required by applicable consumer law.

If a product is faulty, damaged, materially different from its description or otherwise does not conform to the agreement, you may be entitled to a repair, replacement, refund or another remedy depending on the circumstances and applicable law.

We do not limit or exclude any statutory warranty or conformity rights.

Section 9 – Order and Account Information

You agree to provide accurate and complete information when placing an order.

This includes your:

  • name;

  • email address;

  • billing information; and

  • shipping address.

If you notice an error in your order or delivery information, please contact us as soon as possible.

We will make reasonable efforts to update information before dispatch, but we cannot guarantee that changes can be made once an order has entered the fulfilment or shipping process.

Section 10 – Errors and Inaccuracies

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, availability, shipping information or other content.

We may correct such errors and update information when they are discovered.

Where an error affects an order that has already been placed, we will handle the matter in accordance with applicable consumer and contract law.

Section 11 – Intellectual Property

Unless otherwise stated, the content available through our website, including text, graphics, branding, logos, photographs, videos, website design and other materials, belongs to us or is used by us with permission.

You may use our website for personal and non-commercial purposes.

You may not reproduce, distribute, sell, republish, scrape, commercially exploit or otherwise use substantial portions of our website or content without our prior written permission, except where permitted by law.

Section 12 – Reviews, Feedback and User Content

If you voluntarily submit a review, photograph, comment, suggestion or other content to us, you confirm that you have the right to provide that content.

You grant us a non-exclusive, worldwide and royalty-free licence to display, reproduce and use that content for purposes connected with our website, products and marketing.

You remain responsible for the content you submit.

You must not submit content that:

  • violates the rights of another person;

  • is unlawful, defamatory, discriminatory or threatening;

  • contains malicious software;

  • is deliberately false or misleading; or

  • violates another person's privacy or intellectual property rights.

We may remove user content where we reasonably believe it violates these Terms or applicable law.

Section 13 – Third-Party Services and Links

Our website may use or link to services operated by third parties, including payment processors, shipping providers, analytics services, social media platforms and other technology providers.

Third-party websites and services may have their own terms and privacy policies.

We are not responsible for the content or operation of independent third-party websites that we do not control.

This does not affect any responsibility that we have towards you in relation to your purchase from us.

Section 14 – Personal Information

Our collection and use of personal information is governed by our Privacy Policy.

Please review our Privacy Policy for information regarding what personal information we collect, why we use it, who we may share it with and the rights available to you.

Section 15 – Prohibited Uses

You may not use our website or services:

  • for unlawful or fraudulent purposes;

  • to infringe intellectual property or privacy rights;

  • to impersonate another person;

  • to provide deliberately false or misleading information;

  • to transmit viruses, malware or malicious code;

  • to attempt to gain unauthorised access to our systems;

  • to interfere with the security or operation of our website;

  • to collect personal information about other users without lawful authority;

  • for automated scraping or extraction that materially interferes with our website; or

  • to engage in spam, phishing or similar abusive practices.

We may restrict access to our website where we reasonably believe these rules have been violated.

Section 16 – Availability of the Website

We aim to keep our website and services available, but we cannot guarantee uninterrupted availability.

From time to time, our website may be temporarily unavailable because of maintenance, technical problems, third-party service failures or circumstances outside our reasonable control.

We may modify, update or discontinue website features where reasonably necessary.

Section 17 – Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms limits any mandatory rights or remedies available to consumers under applicable law.

To the extent permitted by law, we are not responsible for losses that:

  • were not reasonably foreseeable when the agreement was entered into;

  • result from misuse of a product contrary to provided instructions;

  • arise from events outside our reasonable control; or

  • relate to business or commercial use where a product was purchased primarily for personal consumer use.

We remain responsible where liability cannot legally be excluded or limited.

Section 18 – Force Majeure

We will not be responsible for a delay or failure caused by circumstances outside our reasonable control, such as natural disasters, war, strikes, government restrictions, transportation disruptions, major carrier failures or similar events.

Where such circumstances materially affect the fulfilment of your order, we will take reasonable steps to minimise the impact and communicate with you where appropriate.

Any mandatory rights you have because of a delayed or failed delivery remain unaffected.

Section 19 – Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary to make it enforceable where possible.

The remaining provisions will continue to apply.

Section 20 – No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

Section 21 – Entire Agreement

These Terms, together with the policies expressly referenced in them, form the agreement governing your use of our website and purchases made through it.

They do not override any rights that cannot legally be excluded or limited.

Section 22 – Changes to These Terms

We may update these Terms from time to time, for example because of changes to our services, business practices or applicable laws.

The version applicable to your purchase is generally the version that was available when you placed your order.

The most current version will always be published on this page together with the date of the latest update.

Section 23 – Governing Law

These Terms and agreements concluded through our website are governed by the laws of the Netherlands, to the extent permitted by applicable law.

If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protections that apply to you and that cannot legally be excluded by agreement.

Nothing in this section restricts any right you may have under applicable law to bring proceedings before a competent court.
